Booking & Participation Terms

All participants must be able to swim.

We do not offer refunds within 24 hours of your reservation.

We understand that life and weather happen — if a class or event is canceled due to inclement weather, we'll work to find a new date that works. If rescheduling isn't possible, you'll receive a credit to your account valid for one year or a full refund.

We keep a credit card on file for incidentals.

By joining us on the water, participants understand that they are responsible for any costs associated with the repair or replacement of gear damaged during their reservation, as well as any equipment that is not returned.

All participants must complete a waiver before hitting the water.

Each participant must have a U.S. Coast Guard-approved wearable life jacket in good condition and of the appropriate size readily accessible on their board or worn on their person at all times. Children younger than 13 must wear an appropriate life jacket while underway. Wearing your life jacket is recommended for every participant.

Please note that launch locations may vary.

Photo & Media Release

By agreeing to these Terms & Conditions, I authorize Zephyr Paddlesports to photograph and record me and the participants in my booking, including any minors in my care, and to use those images and recordings on its social media accounts to promote Zephyr Paddlesports without compensation. I confirm that I have permission to agree to this release on behalf of everyone in my booking, including the authority of a parent or legal guardian for any minors.

Paddlesports Activities — Release of Liability, Waiver of Claims, Assumption of Risks & Indemnity Agreement

Please read carefully before booking or participating. By completing your reservation or participating in any activity, you acknowledge that you have read, understood, and agree to these terms.

Parties

These Terms & Conditions apply to Zephyr Paddlesports and its directors, officers, employees, instructors, guides, agents, representatives, independent contractors, subcontractors, suppliers, sponsors, successors, and assigns (all of whom are hereinafter referred to as "the Releasees").

Scope of Activities

"Paddlesports Activities" include all activities, events, and services provided, arranged, organized, conducted, sponsored, or authorized by the Releasees, including but not limited to: paddleboarding, kayaking, canoeing, surfing, snorkeling, equipment rental, instructional courses, guided tours, and all related travel and transportation.

Assumption of Risk

I acknowledge that Paddlesports Activities involve inherent risks, dangers, and hazards including but not limited to: slips and falls on docks, boats, or watercraft; overturning of boards or vessels; loss of balance; collision with or entrapment by natural or man-made objects; hypothermia; drowning; changing weather conditions including storms, high winds, and lightning; encounters with wildlife; negligence of other participants; and negligence on the part of the Releasees, including the failure on the part of the Releasees to safeguard or protect me from the risks, dangers, and hazards of participating in Paddlesports Activities.

I freely and voluntarily accept and assume all such risks, including the possibility of personal injury, death, property damage, or loss.

Release of Liability & Waiver of Claims

In consideration of the Releasees agreeing to my participation in Paddlesports Activities and permitting my use of their services, equipment, and facilities, I agree to waive any and all claims against the Releasees and release the Releasees from any and all liability for loss, damage, injury, or death arising from my participation, due to any cause whatsoever, including negligence, breach of contract, or breach of any statutory duty of care on the part of the Releasees, including the failure on the part of the Releasees to safeguard or protect me from the risks, dangers, and hazards of participating in Paddlesports Activities.

Indemnification

I agree to hold harmless and indemnify the Releasees against any and all liability for property damage or personal injury to any third party resulting from my participation in Paddlesports Activities.

This agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns, and representatives in the event of my death or incapacity.

These Terms & Conditions shall be governed by the laws of the state in which the Paddlesports Activities take place. Any disputes shall be resolved exclusively in the courts of that state.

Acknowledgment

By booking, registering, or participating, I confirm that I have read and understood these Terms & Conditions and am aware that I am waiving certain legal rights, including the right to sue or claim compensation following an accident, which I or my heirs, next of kin, executors, administrators, assigns, and representatives may have against the Releasees.

SMS Terms

Zephyr Paddlesports LLC review-text program

Your choice. When you select the optional SMS consent checkbox during booking, you agree to receive an automated text asking for a Google review after that outing. Consent is not a condition of purchase.

Frequency and cost. You may receive 1–2 review follow-up texts after an opted-in outing. Message and data rates may apply.

Stop or get help. Reply STOP to cancel. You may receive one confirmation of your opt-out. Reply HELP for help, or contact zephyrpaddlesports@gmail.com or (202) 941-7538.

Carriers are not liable for delayed or undelivered messages.

Privacy. See our SMS Privacy Policy for how we use your mobile number and consent records. This SMS section applies only to the SMS program and does not replace your booking terms or activity waiver.

SMS Privacy Policy

This policy covers Zephyr Paddlesports LLC’s optional review-text program.

What we use. We use your mobile number, relevant booking details, and SMS consent and opt-out records to send the review request you chose to receive, manage delivery, honor your choices, and respond to support requests.

Who processes it. Acuity Scheduling, Make, and Twilio help us collect consent, coordinate bookings, and deliver and manage messages. We share information with service providers only as needed to operate the SMS program.

No marketing sharing. We do not sell or share your mobile information, SMS opt-in data, or consent with third parties or affiliates for their own marketing or promotional purposes. Service providers may process this information to deliver and support the program.
